The case concerned compensation for damages arising from a road traffic accident that occurred in 2022. The claimant sought USD 6,000 from our clients as compensation for the value of the vehicle, as well as an additional GEL 2,199.268 per month for alleged loss of income until enforcement of the court’s judgment.
Calculated over a period of just two years, the claim for loss of income exceeded GEL 52,782 and continued to increase on a monthly basis.
The defence maintained that the alleged loss of income had not actually occurred. We submitted evidence to the court, including information obtained from the taxi company and data from the Tbilisi Municipality Transport and Urban Development Agency, confirming that the claimant had not stopped providing taxi services following the accident and had continued to earn income.
The Tbilisi City Court accepted the defence arguments and found that the claimant had failed to discharge the burden of proof regarding the alleged loss of income. As a result, the claim for compensation for loss of income was dismissed in full.
The dispute also concerned the value of the damaged vehicle. The claimant sought compensation based on the value asserted by him, while the defence submitted an independent valuation establishing a significantly lower value. The court accepted the valuation presented by the defence and reduced the claimant’s award in this part as well.
By its judgment of 24 December 2024, the Tbilisi City Court granted the claim against our clients only in part, while the most substantial financial component of the claim — monthly compensation for alleged loss of income — was dismissed in full.
