The case concerned a foreign national who had been refused a residence permit in Georgia on the grounds of family reunification.
During the administrative proceedings, the authorities questioned whether the applicant’s marriage was genuine and whether the family relationship existed in practice. At the same time, the formal refusal to grant the residence permit was based on security-related considerations and alleged risks associated with allowing the applicant to reside in Georgia.
Following the refusal, the decision was challenged before the court. Ani Lomidze, an attorney at our firm, presented evidence demonstrating that the marriage was genuine, that the spouses had an actual family relationship, and that the statutory requirements for obtaining a residence permit on the grounds of family reunification were satisfied.
The defence also separately challenged the security-related grounds relied upon by the administrative authority. It was demonstrated before the court that there were no specific circumstances establishing that granting our client the right to reside in Georgia would pose any genuine security risk.
The court accepted our position and granted the claim. As a result, the administrative refusal was successfully challenged, and our client obtained a residence permit in Georgia on the grounds of family reunification.
