Protective Order Issued in the Interests of Minor Children

The case concerned the protection of the interests and safety of minor children. Our client, the children’s father, applied to the court seeking a protective order against their mother in order to safeguard the minors.

The court of first instance dismissed the father’s application and refused to issue the protective order.

Ani Lomidze, an attorney at our firm, appealed the decision. Before the Court of Appeal, the defence focused on the evidence in the case, the best interests of the children, and circumstances which, in our position, had not been properly assessed by the court of first instance.

The Court of Appeal accepted the defence arguments, overturned the first-instance decision and reached the opposite conclusion, issuing a protective order against the mother for a period of nine months in order to protect the minor children.

The case is particularly significant because, despite the initial adverse decision, a proper assessment of the evidence and the best interests of the children at the appellate stage resulted in a complete reversal of the outcome and the application of the legal measures necessary to protect the minors.
