The case concerned the recovery of a substantial amount of money paid to a real estate development company in connection with the purchase of an apartment in a residential development in Batumi.
Our client entered into an agreement with the developer to purchase an apartment and paid a substantial amount as an initial payment. However, the construction was not completed, and the company failed to fulfil its contractual obligations.
As a result, we initiated court proceedings on behalf of our client, seeking a full refund of the amount paid to the developer. Our position was that, due to the company’s failure to perform its fundamental contractual obligations, the client was no longer required to remain bound by the contractual relationship and was entitled to recover the funds already paid.
The court was presented with evidence confirming both the payment made by our client and the developer’s failure to fulfil its contractual obligations.
The court fully accepted our position and granted the claim, ordering the development company to refund the entire amount paid by our client in connection with the purchase of the apartment.
As a result of the proceedings, our client successfully recovered the full amount of the substantial payment previously made to the development company.
